My mother is owner financing a Mobile Home. The person that is buying the mobile home is not following the contract she signed. She has not shown proof of insurance. is late on payments but does make the pjayments wilthin a 10 day grace period and when it is 10 days late she pays the $10.00 penalty, did not pay the balloon payment,which she insisted be added yearly in order to pay it off early. According to the mobile park owner she is behind in the lot rent. My mother is not liable for lot rent as so stated in the contract. She doesn't return calls on a regular basis. She doesn't pick up certified letters, so she was sent a letter by regular mail and one by certified mail.
When she received the letter by mail giving her two options of paying up to date monthly payment and the balloon payment with interest or to go find other financing to pay off the balance she contacted my Mother quickly.And to show us proof of insurance. If she did not do this within 10 days of date of letter we would start repossession procedings. She deposited the balloon payment with interest added as to what she felt should be the interest. She used simple interest and we used compounded interest so there is a matter of a little over $800.00 that is owed. My brother is trying to take of this situation for my Mother but the lady will not call him.
I think our only recourse is to obtain a lawyer to get this ball rolling. My mother is on a fixed income and has no financing to secure a lawyer. Can we start the procedings on our own and can you lead me down the right trail.
She works for a bank in the loan department. She really doesn't want these procedings to go on.
If she would call , my mother is willing to take $5000.00 and call it quits or the lady can turn the mobile home over and we will not start the procedings.
Area any of these options legal and fair.
