I've just recently taken a job after being out of work for three months, today was my first payday and although they did give me a paycheck I was told I could not go to their bank to cash it, I would have to deposit it in my own account and cash it that way, because the company didn't want to pay the bank $5.00 for cashing each paycheck ( I don't beleive it, but even if so talk about cheap!). Here lay the problem, I work in New York but live and bank in New Jersey, if I deposit an out of state check it will take a week to clear, resulting in my waiting yet another week to get paid. When I presented my situation to the book keeper she told me... TOUGH !! Now I've had many jobs in NY and I've never had a problem with an employer providing a place to cash a paycheck, be it a bank or a check cashing service, as well as additional time on your lunch break to do so. If I'm not mistaken they are required to do so.
Does any-one no if this is so, and if so where might I find documentation on this so I can tell the book keeper to eat TOUGH.

First of all, congratulations on your new job.

Have you called the bank to determine whether this $5.00 charge is correct? It sounds to me like your company is depending on the "float"; e.g., doesn't want the money immediately removed from their account, perhaps due to interest they're making on the money. This is just to see if you're dealing with liars, or straight up people.

Okay, let's assume that the company is correct and that they would get charged $5.00 per check. Hey it's okay if they want to be "cheap" - - "a penny saved is a penny earned". The fact remains is that they don't want you using their bank.

So, does your bank have a New York branch? Would it be inconvenient to cash your check in New York after work? Is there a possibility that changing banks would be an option? What does the employer say to you if you tell them you have opened an account at the same bank? How would that impact their $5.00 per check concerns?

Yes, I've just located a branch of mine that's even closer than theirs.
But that's not the point, this book keeper has been giving me a hard way to go from the start, even at my interview in which they chewed me down to accept $7.00 an hour less than the going rate for my profession, she acts as if I'm taking it out of her pocket, and maybe I am if she's receiving profit sharing, which wasn't an option offered to me. Even today, my first payday, the only acknowledgement I received from her was her throwing my pay envelope across a table at me with out a word, as if it were beneath her to hand it to me. So I guess what I'm asking is if employers in NY are required to supply a means of cashing a paycheck ?

MY RESPONSE: First of all, don't take her actions personally. However, you do need to understand who you're dealing with - - she's a New Yorker. Being a "New Yorker" is just another way of saying "ass-hole". New Yorkers and New Jerseans are the biggest jerks on the planet. It's as if they're born to argue and enjoy being pissed off - - just for the sake of being pissed off. I mean, there's no rhyme or reason to their attitudes. But, you'd probably be the same way if you lived in an overcrowded, shoulder-to-shoulder "shoebox" (as I call Manhattan). Suffice it to say, New York, and it's people, is not my idea of a good time.



So I guess what I'm asking is if employers in NY are required to supply a means of cashing a paycheck?

MY RESPONSE: No. Apparently your previous employers had a "policy" of allowing extra time; much like employers have a "policy" of having a pot of brewed coffee available in the morning. It's not law, it's "policy" - - and your employer probably doesn't have such a policy.

Good luck on the new job, but if this is the way they're already acting toward you, I don't foresee a long relationship for you.
