Paid rent twice

What is the name of your state?California - last month my rent check was placed in the manager's mail box prior to the first of the month. On April 5, the owner/manager of the mobile home park called me and said he hadn't received my check, and needed it then so he wouldn't have to penalize me. Since his office is in the park, I walked him over another one. Then a couple of days later, I was checking my accounts on my banks website an found the he had cashed both of them on separate days. I called him, and he was very apologetic, and placed a refund check in my mail box that day, but before I could get it deposited 3 of my other checks had be paid by my bank with insufficient funds and I was penalized $22.00 per check for a total of $66.00. Do I have a right of decuct that amount from my rent this month if I print off my bank statement showing both rent checks being paid, and the three penalties and place it in the envelope with the rent check?

Show the landlord your statement that shows the bounced checks happened after his bank withdrew on the second check, if he is descent enough he will refund you the fees caused by his error.

Personaly I would pay you.

Rent

First let me say that when you sign a check, you are legally stating that you have the funds in your account to cover the check at the time of your signature. Because you signed the second check, legally you stated the money was there. If this were a court case, the judge would ask you why you did not place a stop payment on the original check. Legally, you can't force him to pay, but if he is a decent landlord, he will offer upon your request. Good luck.

get a receipt with the month, amount of rent, and the LL's signature on it...
The next time he calls, simply hand him a copy of the receipt and inform him that you've already paid rent and it is not your fault he can't find the check...
