pain and suffering

why is it that insurance company takes to much time to approve a settlement?all the facts and results of the injuries is on paper written by the doctors.correct me if i'm wrong but i think lawyers always ask a fair settlement to insurance companies basing from the injuries or the pain and suffering.

Simply because insurance companies are in the business to MAKE money, not pay it out! :D
And generally speaking, they will drag their feet as long as possible, then pay when they have to.

Its a process and a "game". Most attorneys demand way more than they expect to settle for and most insurance companies make offers much less than they expect to pay. Usually a settlement comes when both parties meet in the middle.

Remember, your filing a claim against someone else. In order to receive payment for a claim you must provide evidence and support for damages. Grant it, insurance companies sometimes will drag their feet, but often they are awaiting records/bills/wage statements/verification of employment/doctors reports regarding future estimate expenses and procedures.

When an adjuster goes to issue payment, he/she must justify the amount they are paying. Often they are paying anywhere from $10K-$500K settlement checks and believe me, their employer makes darn sure this payment is supported by the claim file.

my attorney send in the demand without even consulting me but i trust him eventhough the demand was not as much as i expected.i've read my medical files before the clinic gave it to my lawyer including bills.my pain and suffering(permanent neck and back injuries) and the trouble that the accident have caused changed my life.i can't do what i used to do.anyway,does anybody have idea how long the process is?

Let's put it this way....We were rear ended in Nov. 04. My injuries are clearly cut and dry, the other driver admitted liability during a deposition, one of my injuries is permanent and has been accepted as such through their attorney and insurance subrogator. It is now 18 months since accident, just spoke via email with our attorney, and as of today....no settlement dollar amount (demand letter) has even been discussed.

Sit tight....it's going to be a loooooong ride.
