Parental rights terminated by the state

My husband and I live in NC and he is ordered to pay support for a child in the state of Washington. He was never married to the boys mother and began paying child support in 1994. The child lived with us for 10 months in 1994 but had many behavioral problems that we were unable to deal with at the time so we had to send him back. Shortly after that the state of Washington terminated my husbands rights and he is still ordered to pay support. Our question is, is he still obligated to pay if he has no parental rights and is not allowed to speak to the child only write him. The boys mother is a prostitute and drug user and her rights were terminated as well but she has visitation rights and does not have to pay any support. If someone could give us some help in answering the question if he is still obligated to pay support it would be greatly appreciated. Thanks.

My response:

Parental rights or having visitation rights, have nothing whatever to do with the obligation to pay child support. These are all separate issues, and none are dependant on the other.

Who should pay for the child?

The State?

I appreciate your reply but my problem lies with my husband not making much money and I basically support our family (we have 3 small children) It burns me that I can work so hard to take care of my children and then there are mothers who don't have to even after they abandon them. It would be one thing if my husband had rights to the child but he doesn't. He pays more than he can afford as is. Sometimes I just don't know where to turn. So yes I believe the State should pay for this child. He can be placed for adoption but is too mentally ill for any one to adopt. It is draining us. That is my only concern.

My response:

So, what you're saying is this - -

"Because my husband was completely stupid by not using a rubber, I think the taxpayers should pay for his mistake, and pay for his child."

Life (and the law) doesn't work that way.

How old is this child? Why did your husband start paying support in 1994? How did your husband become the father to a child of a prostitute? Furthermore, not to sound insensitive but why did you have another child in 1999 if you were having problems supporting the children that already existed? I have tried to get IAAL to reply to several of my posts without much luck but at the sametime what he says is usually coming from a valid legal stand point.

I don't know how your state works but evrything I have read indicated that once parental rights are removed all parental responsibilit (child support) and all parental contact stops too

DWH1231, wow could you get my ex the site that tells you you are no longer obligated to pay support if your rights are terminated??? I am sure he would love that one!!!!! Maybe you should go over the information you obtained again.
