What is the name of your state? California
Daughter backed into car that was standing in the parking lane about to drop off a passenger. Is there any shared responsibility?

In TX i was backing out of a space and a van was parked illegally in a fire lane so it was 50/50 according to the insurance company............I PAID $300 and never heard another thing about it. To keep a claim off of my insurance.......$600 was his claim.

The question is is there a degree of responsibilty for essentially standing in a lane without moving yapping to a friend instead of moving along. The road isn't a parking lot right?

I disagree, it was your daughter's responsibility to make sure it was safe to back up. If the car wasn't parked and was moving your daughter still would have hit her.

But what I think is irrelevant, ultimately the insurance companies will decide.

Thanks for the reply. If the cost isn't too much shouldn't I pay it and avoid involving insurance company and subsequent rate increase? If that happens I should get the other party to signoff on any furthur responsibility yes?

I would agree with you. You have to take into consideration what a claim may do to your future premiums. You also would be on the hook for the deductible; so if the difference is reasonable, then settling it without the insurance company may be in your best interest.

Yes, make sure they can't come back and bite you.
