Partner stole money and company property

What is the name of your state? California

Help! I am 1/3 partner in a "General Partnership" and one of the partners decided he would go to the bank and write himself a check for $4000 and then went to one of our customers and had them pay their bill with a check written to him personally. He also came into the office in the middle of the night and stole the company computer and all of the files. Now I am stuck covering bounced checks and dealing with vendors looking for payment.
Anybody have any suggestions? Is what he did criminal?

Have you reported the theft to the police?

Partner stole money

State of California-

I called the police but because he is a partner and has a key to the building they cannot do anything. All of us partners are "signers" on the bank account so it is against our partnership agreement but apparently not against the law for him to walk into the bank with a company check and write it out to "cash".
