What is the name of your state? MD, VA and OK


Is it typically an issue to obtain a passport for a child (7yrs)? I want to take him on a cruise either this year or next and I need to obtain a passport in order to do so. I just talked to my ex about it and it appears that she is planning on being less than cooperative. I have a court date the beginning of May, and am considering bringing it up there. Will a judge order her to sign the consent form?

Just so everyone knows .... I have no intention of "running away" or anything like that. I just have the means to do fun things with my son and want him to experience eveything. My ex seems to think that i "have something up my sleeve." Thats not my MO, it's hers. She's the one that told me she wanted to keep things out of court and then up and moved 1400 miles away. Who's got what up their sleeve?

Anway, sorry for the rant! My question was whether or not I have a chance having the judge order her to sign the consent form? We're only going to the Carribean (people go there all the time).

The judge can order your ex to sign the consent form for the passport at the hearing. Be prepared to explain to the judge why you want the passport, what you want it for and that you will inform your ex of when you will be going. when you will be leaving the country and when you will be returning.

If the cruise departs from the US, you don't actually need the passport to take the cruise. You do need it in order to leave the ship if the ports of call are located outside of the US. On almost every cruise, there are at least a few people that forget or misplace their passports that have to stay aboard the ship.

Wow ... thank you! I didn't realize that. So, as long as we take a cruise that originates in the US, I don't need a passport for him, even if we sail into international waters? As long as he stays on the boat?
We will start planning our cruise then, maybe we'll take grandma too!!

Call the cruiseline to double check their boarding requirements, but last time I checked (mid 2005), that's the only reason a passport was needed.

As of December 31, 2006 "Everyone" will be required to have passport to enter/re-enter US. No exceptions to this.. so if your planning on going outside of U. S. Boundaries after 12/31/2006, time to send off for a passport..

The last time I looked at a passport application is only requires one signature of parent for child not both, along with 2 2"x2" passport photos and certified copy of Birth Certificate to send with application to passport office.

Depends, I signed up for a program that informs me if my ex attempts to get a passport for our child. You send in a copy of your CO. They will not allow it without my permission.

My ex and I are in the process of getting a passport for my daughter. he had to sign an affidavit allowing me to apply for her to get one since he couldn't be there at the time I was going to get it. Or when I will get it.
 
For a child under the age of 14, both parents must sign the passport application or one must sign and provide a consent form from the other parent. The consent form is available for download from the travel.state.gov website. The only exceptions to this rule are listed at the same website & they are very limited.

Yes, its certainly possible that you could get the judge to order her to sign the passport application. However, you need to make a motion on the issue ahead of time. You really can't just bring it up in court that day. Do it right away.
