We fell behind on HOA dues in a condo we own and rent out. The delinquency began in 2015 due to loss of employment. When we discussed the hardship with our HOA they assured us that they would work with us, "do your best", and worst case they would recoup the dues when we sold. We informed them of our plan to sell in summer of '17 and have upwards of $100K equity in the home. It's been almost a full year since our last payment of our dues that run $230/mo. Yesterday, without any further communication with us or the tenants, the HOA served our tenants with an eviction notice, citing unpaid HOA dues, late fees, and legal costs of upwards of $5800. A court date has been set for 7 days from today (8 since notice given to our tenants). Unfortunately, we don't have $5800 cash on hand, we currently live out of state, and just signed the tenant to another 12 mos lease. Our intention is to repay the past due fees in time and really don't want to jeopardize our tenants home. Any advice for a resolution or insight on what to expect in next steps of the legal process would be appreciated.

It sounds as if the HOA has decided that they cannot wait any longer to be paid and telling you they would work with you , ill bet they were hoping that you were going to make smaller payments or do something sooner and likely theres enough outstanding dues owed by you and others that it may begin to truly hurt them.( eventually common area maintenance that gets delayed can make repairs more spendy and drag every ones market value down) then it If you have 100k in equity in it then Id suggest you go find someone to lend you the money
