What is the name of your state (only U.S. law)? SC

I just found out that the $700/month I have been paying for daycare is being pocketed by my ex. I knew that they had started going to some after-school program at the public school to help them with their homework. She said they were still going to daycare too. I just called the school and the after school program is from 2:45 to 5:30 every day. They aren't going to daycare at all! She's just been pocketing the money. Plus she works for herself cleaning houses and can set her own schedule. No reason she can't do this while the kids are in school. There are grandparents that would keep them as needed during the summer.

What can I do to stop this robbery?

File for a modification in court, and provide your proof.

Forgot to mention that this money is being garnished from my pay. So, it's not like I can just stop paying it. Anybody ever heard of a setup where the daycare is not garnished but the NCP can pay directly to a daycare rather than give it to the CP?

As long as it's court ordered, you can't stop paying it regardless.

Yes.
You'd have to have your court order modified to that standard.

WHAT DOES YOUR ORDER SAY REGARDING CHILD CARE?

Also, what is the amount of child support you pay?

People can't give you proper advice if you don't answer their questions. But here you go anyway:
SC Child Support Enforcement - Child Support Obligation Calculator

That the link to the State of SC child support calculator. Find out how much the afterschool program costs versus the previous daycare and see if your current obligation amount would change.

However; the wording of your court order affects this answer (as in - does it specifically state "daycare" or does it say "child care"?)

just FYI, it's possible she has to clean the houses according to her client's schedule. i wouldn't want someone at my house cleaning WHILE i was making breakfast or dinner. i'd rather be out of the house while they clean.

How do you know that she doesn't still need to pay the after school care fees? Also typically programs to help with homework are not every day.
