What is the name of your state? Alabama

We had by mistaken gave a check of the bank we have closed the account with. And we are paying 25$ bounced check fee + 35$ late fee = 60$

When we went to give the rent plus 60$, the apartment would say, they dont' accept check, since it was bounced. They want money order or cashier's check.

Since we are paying for the mistake, why should we give money order/cashier's check?

What right I have not to give them cashier's check (im losing more money).

By law, can I say, i could only give normal check?

The LL can demand payment by M.O. or Bank M.O., it is not HIS fault YOU wrote him a bad check... It is within his legal rights to demand a more "secure" payment method from you, and he can deny another personal check from you...

Don't be stingy and spend the $.99 at K-mart to get a M.O., or you might find yourself eviceted!

The landlord can request M.O /Cashier check until further notice, it may even state so on your contract.

Don't be a tightwad

The landlord does not have to take a check. There is no law stating he has to take a check. He does not trust you because of that bounced check and he wants to make sure it doesn't happen again and when a check bounces it is a pain in the backside to the person who recieves it. Don't be so damm cheap. You can buy a money order at Wal-mart for less than a dollar and these cannot bounce and therefore no overdraft fees. If you keep objecting to purhaseing a money order and give him a hard time you might just find yourself getting an eviction notice. IMO you are acting like a jackass about this.

...the contract says, if the check bounces TWICE, then they require MO or Cashier's check.

I'm ready to get evicted. Apart from eviction what else I would risk? What other things they can do?

What do you mean you are ready to get evicted? You want to mess with your rental record, credit record and all that over this... jeesh I am done with this thread... Its gonna cost you a lot more than the cost of a money order.

because there are some things in life worth fighting, and some that aren't. this isn't one of them.

for example, when i moved in to my new apartment, i never got a copy of my lease agreement (LL's fault). the due date on my rent payment was the first business day of the month, instead of the third business day like the last place i lived. so i went to pay and pikc up the copy of my lease and discovered that i was two days late. they insisted on the late fees and payment in a MO, even though my lease didn't require it. i agreed to not fight the MO issue (which would cost me $5 at the kwik-e-mart) if they agreed to remove the late fees since it was their fault i didn't get my lease in a timely manner. if i had fought both points, they probably would have shot me down on both points.

if you still think that a MO is a hardship, then you are leaving something out of your story.

Why are you so upset about paying by MO. it is not that big of a deal. At least with a money order it cannot bounce. you are making too much out of this. bTW if you were my tenant I would not accept a check from you once you gave me a rubber one and if you didn't like it then you could move. also by the way the landlord owns the property you don't he is in charge your not and if you do not like it then leave. you are having a fit over something that you caused. it is your fault not the landlords.
