Permanent Custodianship

My 4 year old son is living with his grandmother who has permanent custodianship of him, my rights were NEVER terminated. Now she is trying to push to adopt him and get my approval; I of course am not aggreeing to it. I am wanting to reverse this order and have him returned to my custody. There is also a child abuse/child neglect issue because when he was only 3 she bought him a bb gun shotgun. And every visit I have with him he is always telling me about him going hunting and killing animals. I feel that this is very age inappropriate. Now since I am wanting to reverse the permanent custodianship order how do I do that?? has this been done before and if so can you point me in the right direction of how to do this or previous cases that I might be able to look up on this sort of thing.

What proof do you have of the neglect and abuse? Why did grandmother get permanent custody of him? Are you mom or dad? How long ago was this order put in place? How often do you visit? You might not be able to reverse it.

Well as for proof both my son and his grandmother told me as well as she gave me a picture of him holding his new bb gun shotgun. grandmother got permanent custodianship from a CINC case. I am the mother. the order was put in place in 2008. I get visits 2 times a month.

Then prove that there is a substantial change in circumstance in the life of the child since 2008 that requires for the child's best interest to be placed with you. Oh and did you complete your case plan? Because that will come into play as well.

What grandma told you isn't proof unless she's willing to testify in court on your behalf - and that doesn't sound likely.

What your son told you is not proof - he's far too young.

The gun? You claimed it was a 'bb-gun shotgun'. What, exactly, is it? It's either a BB-gun OR a shotgun, not both.

And in KS, I'm not sure that giving a child a BB-gun constitutes abuse - as long as he's properly supervised.

The grandmother could be called as a hostile witness in a custody case but that doesn't mean it will be considered proof of anything wrong. The child is far too young. But in order to bring the case and succeed, she needs to prove that there is a substantial change in circumstance and that she has successfully completed the case plan and that it is in the child's best interest to be returned to her custody. Those are HIGH hurdles. Only one of them won't do it.
