I have over $18,000 in debt on credit cards, store credit cards and overdraft line.
I am retired and net about $19,000 after taxes from a state pension....My husband is also retired but understand that he is not responsible for my debts.

I am having trouble paying these and food and utilities and other necessities and having money left over, especially the last week of the month....Have been borrowing from my son's credit card and paying that also.
Will I be able to file a chapter 7 bankruptcy? Thank you. :o I am not sleeping well at night.

Yes, you can file for bankruptcy. Does your husband have retirement income ? His income would have to be reported on your Schedules, but he would NOT have to file with you.

Yes LadyinRed , my husband has retirement income also...2 small pensions.....
I am just worried that my pension will be considered enough to be able to pay back what I owe....

I have already payed less last month (only $10.00 each) and the calls have already started from one credit card. The late fees and over the limit fees have pushed the minimum payments to the point that if I pay them in full and the utilities, food and other responsibilities, it would leave me with nothing.
