PHOENIX, AZ - :mad: The company I work for filed bankruptcy and employees were told that the company was required by the court to provide employees personal information (i.e., name, title, SSN, home address, amount owed, etc.) to the court. We were also told that the court would provide some safeguards regarding the dissemination of that information. Come to find out, the personal information was included in a letter sent out to all of the company's share-holders. The company sent our information without our consent and then told us about it after it was too late and then lied to us telling us that the court would be the only ones to see it. Employees here are very concerned about identity theft and the company is just handing over our information! Is there any legal action we can take against the company? Thank you!

The company is in bankruptcy. Chances are any legal action would be prevented by the automatic stay.

The personal information on all employees was probably REQUIRED in the bankrutpcy becuase you are, technically, creditors - they would owe you wages. So ALL creditors must be listed. Bankrutpcy is public information, including the list of creditors.

Your concerns of identity theft are justified, but I don't know that there's much you can do in this instance. The only way to find out would be to speak to a lawyer, one that is familiar with bankrutpcy.
