We signed our lease at the end of January and we didn't have a pet at the time. We checked the lease before getting a dog and it didn't state in the lease that there was a fee, so we went ahead and got a puppy. Recently we received a letter from our rental company advising that we must pay a $250 non-refundable pet fee. I went to the landlord and she stated that the lease tells us whether we can have an animal or not. But once we get one we are obligated to pay the pet fee. Is this legal since it is not specified in the lease?

*** In one place you say "t didn't state in the lease that there was a fee" and elsewhere "she stated that the lease tells us whether we can have an animal or not".
So, what EXACTLY does your lease say about pets???
 
I am a Florida Landlord and I charge a $100 pet fee, I put it in the lease if the tenant has a pet. If the tentant has no pet the lease says no pets. If a tentant with a no pet lease wants to get a pet I rewrite the lease to include the pet fee. I suspect your landlord may do the same, check your lease if it says no pets or some how addresses pets then I believe your landlord is within his or her rights.

In Our Lease It Talks About A Pet In Two Places.
The First There Is A Box That Is Not Checked. After The Box It Reads "a Pet Fee Of _____ Is Due Uponing Signing Of The Lease." The Second Is In The Stipulations And It Reads : "the Tenant Shall/shall Not (mark One) Have A Pet With Out The Permission Of The Landlord." However Neither Shall Or Shall Not Is Marked. There Are No Other References To A Pet Anywhere In The Lease. So Is It Legal?

**A: yes, it is legal for the L to charge a pet fee.

If you type your message in caps and then submit it, it automatically makes every first letter capitalized.

Guru, it doesnt specify anywhere if we can have a pet or not b/c none of the boxes are checked. Nowhere did we sign a paper that stated if we got a pet then we would be obligated to pay a pet fee.
