Hi guys,
Called the district court in the county of Delaware in the State of Pa and was told the districts courts always side with the landlords
this is B-----it this landlord is nothing but a gloried slum lord, we paid her alot of money $24,000 to live with a ceiling falling down, a bath tub glazed that is disgusting and a front door that does not look, where and who protects us????? I was told we could appeal this nonsense and on top of all this My husband is in the army reserves, Is this is how we treat people who put their butts on the line. I am totally pissed off and with the legal system in this country,,,,
we complained to a government agency to help solve the problems and this is what people get who speak thier minds,,
where is our justice????

A1) Who told you this?? Was it a court officer, or a 'wino' in the parking lot?? Could it be that most landlords win because they can prove their case... or that the renters dont' show... or that the renters have no case??

A2) Your first 'protection' is yourself. Why in God's name did you pay this person $24,000 (in rent I assume) for a property like you described?? Why did you not take PROACTIVE action to fix these problems in a timely manner?? Why did YOU wait until you (apparently) got evicted to find your 'voice'??

A3) Your husbands occupation has NOTHING to do with this. The fault (if any) lies on your not handling the problems properly as allowed by law. You say nothing about what brought this legal case, but I assume it was due to your failure or refusal to pay rent. What did you do??

A4) Again, your husbands job has NOTHING to do with your situation. It appears that you didn't do something you should have and have now suffered the consequences.

A5) Gee, I guess that getting totally pissed off is one of the rights your husband is helping to support. Thank him for me, will you??

A6) Don't understand what you are saying here.... did the 'government agency' not fall too their knees to help you fix YOUR problem?? What 'agency' are you talking about?? What problems did you want them to solve??

A7) Right where it has always been... in the hands of the people.

Now that you have exercised your freedom of speech, to get all that anger and piss out of your system (Freedom is nice, isn't it??), how about your posting some relevant facts so that we can see what the problem REALLY is?

excuse me, but we paid our rent in a timely fashion the landlord was aware of the problems before we even took residance we wore told that these problems would be fixed and they were not
the landlord is trying to sell the house, and cant, because of the condition of said property, she told us that we were pigs and that our furniture was not showing the house in the proper light,, hell the house is painted dark, the ceiling is a mess, why did we stay you might ask because both myself and hubby just came off of divorces. so before you pass judgement, stop and think not all tenants are evil people who abuse the property

1) Were you sued by the landlord??
2) What was the basis of her lawsuit (can't imagine it was because of 'the furniture')??
3) What was your defense??
4) Did you lose in court??
5) What amount??

And finally, how long did you live like this and why??

according to her own legal lease
month to month lease, it was to be given to us before or on the date the next rent was due. November 1, the letter did not arrive until the 4th of November the landlord and her attorney both stated that they could not get federal express to deliever it to us, the lady lives ten minutes away why couldnt see leave it in the mail box or even send it by UNITED STATES MAIL, ,,so another thing they said in court was that my husband interred with prospective buyers when asked who are making theses statements they could not answer this
so again
not all tenants are evil...

the landlord sued us
for novembers rent of 950 and possession granted was awarded
she wanted late fees did not get any and damages to real property was not awarded

she also stated that we did not care for the property failure to pay rent in a timely fashioned and failure to cooperate in the showing of the house to prospective buyers,,,, hell people would enter the house and look at the ceiling and leave,,
you cant miss the messed up door jam

we had pictures of these problems and showed the courts

The landlord neglected her own property We only lived in this mess to long,,,,two years of living, yes that is a long time however the kids love the neighborhood, the schools are very good

she would do walk throughs was her eyes covered to see the Mess, the bath tub, the ceiling or she just didnt give a dam about this property or did we pay rent to keep her house in another part of town from falling apart
she once stated to us that she was not going to lose her house

So, the landlord gave you your 30 day notice to terminate the month-to-month agreement, and in response, you refused to pay your last month's rent? Then, of course, the landlord had you evicted for failure to pay your rent? Correct?

Your landlord had every right to end your month-to-month agreement. That's the point of a month-to-month. Now, if they gave you notice on November 4, you may have been able to say they didn't give you proper notice to be out by the beginning of December, and could conceivably have stayed in the house until the end of December (you certainly had ample notice for that). However, the catch is, YOU HAVE TO CONTINUE TO PAY RENT. Once you chose not to pay November's rent, they no longer had to give you 30 days notice, they just had to evict you for non-payment.

The courts did listen to you, they paid attention to the pictures you had documenting the place was not in good shape when you moved in, and did not hold you responsible for damages the landlord tried to pin on you. They also held you responsible for paying your rent, which you should do. They did exactly what they were supposed to do.

You may have 10 days to file an appeal, but the bad news is, if the landlord got a judgement of money from you, you will have to deposit that amount (or more) with the court before they will allow you to appeal.

That way if you lose again,the court will just give the landlord the money and an order to the sheriff to toss you on the street.

Ann you posted that the LL was there and so were police and realtor , do your self favor review in your state statutes under landlord tenant how much notice is to be provided for NON emergency entry to the unit by a LL or LLs agent . then print the result ( no printer then save it to wordpad and to a 3.5 diskette and take to library and print ) then send copy to your LL and send it using a certificate of mailing , ann do you have any reports from your citys housing inspections unit about the repairs needed ? I suggest you get them if you go back into court show them to the Judge. any complaints you have about conditions of the house you must back up not only with pictures but Ill bet reports from housing inspector , last go to nearest legal aide society and ask for help to make sure you cover all the bases . IT is possible you might qaulify .
