Can he stop my record??
What is the name of your state (only U.S. law)? California.
I am taking an engineer to small claims court. He engineered my record, also played guitar and bass tracks. It's the record that I am using as a demo to shop for a record deal. I am suing him because he held my album hostage if I didn't pay for the repair of HIS hard drive.
Our court date for this small claims action is coming up... in the meantime...
He is now saying that because I am suing him he is going to claim that he did not know I was recording a "record". He says that if he knew that he would have charged us union rates... but because he thought it was just a demo he didn't. He said that because of this we cannot release our record. He is lying, he knew that we were working on what we were sending to labels as our record...but should any of this be threatening to me? Can he stop me from using my record? We had no written agreement between us (stupid) but he just told us how much to pay him and we did pay him the amount he requested. It was a work-for-hire. Is this guy full of it??? He is threatening to take me to superior court and get the union involved... and I don't even know what he's talking about... I don't know if he's just mad and trying to scare me or if I should be concerned.
