I'm divorced and have a 15 year old daughter. I've been having problems with her mother doing drugs for years. Marijuana, xanax and somas. The first time she was arrested for Cruelty to juveniles. Her 6 month old went to the hospital with 2 broken legs and a lacerated liver. I got temp full custody of my daughter but after she went to parenting classes, past her drug test and got off probation we decided on joint custody with me being domicile parent. The second time she was smoking marijuana with her 2 other sons and my daughter in the house. I had photos of the pipe and marijuana that were in her trialer. A friend of my daughter took the pictures and a sample of the marijuana that were in her trailer. We went to the Police Department to file a report but nothing was ever done on their end. I took the ex to court and she agreed to a years worth of random drug testing plus she visits with my daugther from 9-5 every other weekend(Sat+Sun). Her fourth ex husband called me tonight and stated that while he was over at her house picking up his clothes he found a weed pipe in the bathroom. She admitted to him that she still smoked wee but drinks plenty of water to flush her system out. He also found a bottle of 180 pain pills, 120 Somas and 60 xanax that were filled on Feb. 18th. All of the bottles were empty. He also walked in on her giving or selling her drugs to some friends on two different occasions to which she admitted to him. He told me he would get on the stand and testify for me for the safety of the children. Will this help me in court? She has been testing neg for marijuana but we received one that stated dilute sample. I'm so tired of fighting this fight with Child protection service and Police Dept. The system is set up so that losers like my ex wife continue to keep custody of her children until one of them turn up dead, then they finally do something after it is to late. Pleas help me because I am running out of answers.

Was she convicted of the child abuse?

The first time she was arrested for Cruelty to juveniles. Her 6 month old went to the hospital with 2 broken legs and a lacerated liver

I know that she had to have supervised visitations, had to go to parenting classes and had to submit to drug tests. Her probation was for about 3 years. Her lawer would not let me in the Court because he knew that we had a daughter together. The final outcome of the case I'm not sure of other then what I listed but I do have the court transcripts. And what about using her ex to testify about what he knows regarding smoking marijuana and selling drugs? Is he a strong witness that could determine the outcome of the case? I fear for my daughters life and the other children, I'm also tired of her slipping through the cracks in the system!! She stated to the ex husband that she pretty much knows when I'm going to give the drug test and flushes her system of the marijuana. I'm just frustrated and hope that having the ex testify will really help resolve the situation with my daughter. I would like full custody with as little visitation as possible because her mom is reckless.

Read the court transcripts and see what the out come of the case was...I can't imagine being convicted of FELONY child abuse and not getting prison time.

I'm scared for my daughter and I'm afraid she will end up raped or dead!

No one here can really tell you how having the X testify will impact your case. The X will not be considered the most reliable witness as he is not an unbiased third party. As far as the court knows he may have a serious ax to grind with your mutual X and therefore the court may not see him as credible. It really depends on the mix of evidence you bring to court and what kind of character you show this guy to have. If he was with your X while she was doing the drugs, abuse etc..., he will not look good. His character will be called into question, what kind of guy marries a girl like that. See what I mean?

Yes, i do see your point and aprreciate it. I'm just scared and trying to get peace of mind from some of the polite and courtious members here. If this guys back ground check was ran, it would show up cob webs. He's had no arrests or has been in any kind of trouble. I trusted my daughters life with this man and still would to this very day.

You won't necessarily like this answer, but since your daughter is 15 rather than 5, safety issues are not as significant as they could be. Your daughter is old enough to call you, or even 911 for help if things get out of control, and you have the ability to instill in your daughter the necessary values/mores to ensure that she will not follow her mother's footsteps.

Getting a counselor/evaluator/GAL involved might be more valuable that the other ex's testimony.
