I am 3/4 of the way done today. I believe the most difficult task is what I'm about to go do.
First things first. I called Dhs this morning and told them I needed to file a complaint and ask for an investigation. I gave them all of the pertinent info regarding Dad blatantly ignoring Dr orders upon Sons release from the hospital. The danger Son's life was in just one very short week ago, plus the potential risk that Dad caused to my Son as well as any other people that could have been in contact with Son at the football game. They would like to interview me in person to see with their own eyes, the proof I have of my "allegations" against Dad. I will be going to my county's DHS office tomorrow to meet with someone, and an investigation will be opened.
Next, I took Son to the Dr this morning for his follow up. He had to go in for Xrays and his lungs look a tad bit worse than when we left the hospital. His doctor was absolutely furious about Dad not giving the breathing treatments and not using the Nystatin cream. She asked me for Dads address and telephone number and I gave it to her. She was also quite upset that Dad stood there and allowed his wife and father to "beat me up". She told me to immediately get restraining orders against all of them covering the kids and I. I told her that was my next step. She gave me a complete copy of kiddos records since his birth. In her opinion the records prove dad is detrimental to Kiddo, because he never had problems until Dad started taking him. I agree with her personally, but feel her own opinion probably won't be worth much to the judge.
I went to Walmart and got the extra copies of the tapes. Then went by the police station and picked up the police report. I also asked them why I wasn't given the option to ask the charges be pressed against them. They had no answer as to WHY NOT, but told me I do have that option. I said "Great, let's get it done. Tell me what you need from me to get the ball rolling.". I was then told that, they would probable ask charges be filed against me also.
After reading a bit of the police report, it is noted that we ALL engaged in the "fight" and that all parties involved were at fault. I spoke with the chief of police and asked him just HOW I was at fault when I never once laid a finger on them nor did I engage in the yelling, name calling match that ensued. He said it was essentially their word against mine. I told him the two officers that came to WM that night took a copy of WM's parking lot surveillance video that shows them initiating the confrontation and pushing, kicking, slapping, punching, and slamming my head against the truck. Amazingly, no one besides the original two officers had any knowledge that such a video existed. The cart pushers statement to the police was not included in the report either. And where my daughters statement is written it says "Obvious Bias for Mother". So my daughter is being discredited because her story matches mine, the cart pushers AND the video? Bull.
The chief said he would speak with the two officers to find out exactly what is going on and WHY. I am now only to communicate with him and he has a copy of the video, as well as the cart pushers statement that was left out. I do not know what is going on.
Next stop, my county courthouse to ask for ROs. I did the affidavit and other things the clerk told me to fill out. I went before the judge within 30 minutes. TROs were issued protecting myself and both children from Wife and Grandpa. Judge would not issue one for Dad. He seemed sympathetic that he couldn't do it. He said if I cannot get the relief that is necessary from the family court, to go back and refile and he will issue a TRO protecting my daughter and I from Dad. I told him I was more worried for my son than myself because of Dads complete disregard for Sons health. He said he understood and hoped that the other county would be fair. The hearings are scheduled for Dec 1st at 9a.
So, that brings us to now. I am about ready to head to the family court to file an emergency petition to suspend visitation, or at the absolute least, supervised. I wanted to see if you all could give me an idea of what may happen. Do you personally feel it is likely that visits will be suspended or at least supervised? If the judge agrees to supervised, who shall I ask that the supervisor be? I don't believe that there is a supervision center in either of our counties. I just want Son to be safe and cared for when he's with his Dad. I don't feel that he, his wife or father are capable of properly caring for him, especially now, with son newly released from the hospital.
I want you all to know that when I take my time and yalls time to ask for help, I fully intend to take the advice. I don't just ask for the heck of it. And I sincerly appreciate everyone who has taken a moment (or several) out of their day to help me and the children. I will be forever grateful.
Does dad have any other relatives local that would be appropriate supervisors?
You need to push the police hard on the charges against the wife and grandpa. Either the officers didn't want to bother with trying to find them any further, after the initial attempt, and adjusted their reports accordingly...or they did hook up with dad, and bought a story from dad.
