Geez!!! There has to be a special place in hell for creeps like these.

I am so sorry you have had to go through this after what you have already been through!

I hope this is enough for dad to lose custody altogether. Your child does not need to be around such toxic people!

I sincerely hope that things turn around and get better for you soon and that you have an amazing holiday season!

Oh Dawn, I felt sick when I saw just the TITLE of your thread.....then I read the whole fiasco from yesterday and I am beyond upset for you and your little ones. How horribly frightening for them and you.

I don't have any legal advice....except to ask the smart people here if, under the circumstances and just as an added precaution, could her daughter be included in the restraining order, since she was present during the assault. These people are clearly nuts!

At this point, I would be asking for supervised visits from dad with a place that could take care of kiddos needs.

This DOES qualify as an emergency visit in front of the judge.

Have you filed your police report yet? If not, see if you mom can watch the children and go down to the police station.

I'm still debating if this one qualifies for a CPS visit. With a confirmed diagnoses of H1N1 and the strict instructions from the hospital, it clearly falls under the auspices of child endangerment. How is the kiddo in light of his exposure to the elements yesterday?

What Liandra and Tink said -- I agree with. You need to go to court MONDAY.

Go get a restraining order against ALL of them, including dad, get the child included on the order based on the fact that all of that took place with the child present. File for for an emergency suspension of visitation based on the child's illness and the fact that dad did not administer any of the child's medication.

Ask that when dad's visitation resumes it resumes as supervised visitation.

In other words, throw the whole book at him, in every way that you can. He sat there and laughed while his wife and her/his father beat you up.

See if you can get another copy of the tape to show the judge in the emergency hearing and the hearing for the restraining order. Do that quickly because Wal-Mart may not keep the tapes very long.

Add that I am agreeing with LD and CJane.

In addition to the restraining orders against SM and gramps wouldn't criminal assault charges also be involved here?

Perhaps if there are charges coming from the state/county/city (whatever) side and the punishment that may be handed down those people will stop acting like fools.

How terrible! I agree restraining orders for all with you and kids named. The whole family is crazy. I am so sorry that you and the kids had to suffer all of that. I can only imagine how scary that must have been for you and definetly for the kids. I hope they get the book thrown at them in criminal court as well.

If you can't get visitation suspended/supervised, at least get the exchanges to take place at or in the police station.
 
Thank you all so much for the advice. I definitely plan to do everything suggested. I didn't mean to post and run, but when my mom got here she made me go to the ER. My mouth looks horrible and my head has been throbbing non stop since last night. Add being pregnant to the mix and its more worrisome.

I have some questions.

When I file to get the restraining order, do I file in my own county or the same court that holds jurisdiction over our child?

And when I file, I file for myself, and BOTH children, against all THREE of them, correct?

From things I've seen before, I can file, and immediately go before the judge and he should issue a temporary RO. Then they will all be served for a permanent RO hearing?

I believe I can call DHS in the AM, I think that's our version of CPS. Maybe not, but they can at least point me in the right direction.

Should I go for the RO first, or to try to get visitation suspended first? Does the same court handle both? Probably not, one is family court and the RO would be criminal or something? How long should it take if I file for emergency help in getting visitation suspended to get before a judge?

I have about a million questions in my head but I can't figure out how to formulate them into actual questions I can ask you all.

Some of yall asked how the baby is. He wheezed a LOT last night and woke up a lot more than usual, crying. His follow up is first thing in the AM. Hopefully, we can be in and out of there fairly quickly so I can get on the ball with everything else. I stayed up most of the night last night, worried that psychos might show up at my door to continue. I got my stuff all together in a binder that should be easy enough to read through should a judge ask to see it. Text messages came in all night, from Dad and wife. They were threatening to say the very least. I took time to write out all of the messages onto paper, plus saved them in their own folder on my phone so they can be easily accessed. That includes the ones from the hospital also. I also did the same for the 2 voicemails from wife. I deleted all of the other voicemail from the box, so if a judge asks to listen, those are the only two on there.

I called the police station this morning. They asked if the officers had given me a business card with a hand written number on it. I honestly didn't remember getting one. But I called the Walmart manager and it was laying on the desk there. I called the station back and gave them the number. They said I could pick up a copy of the report Monday morning. So I will add that to my records as soon as I can get it.

Do you all think I have enough right now? I can try to get my hands on anything that you think may help. I don't know if me transcribing the texts and voicemails will be enough, but at least its something that can easily be handed to anyone who needs it.

My little girl. I think she took it all the hardest. I let her sleep in my bed last night and she had nightmares all night long. She cried in her sleep, and yelled out about 5 times. I wish she went back to school this week, but she is out alll week. I'd like her to have someone more professional than myself to talk to about everything that happened. Poor girl.

Daughter and son are about the only thing that helped me keep my composure last night. I'm not one to stand there and let someone slap, punch, and pull my hair. I normally wouldn't have the will power, but hearing my daughter cry in the car was just what I needed to hear I guess, because it kept me from seriously hurting all of them. I was upset enough that I absolutely could have caused some injures. Mama bear mode, I guess.

I really hate your ex. That's the only thing I can get out of this. He doesn't deserve to see his kid ever again after putting his life in danger like that.

After the assault yesterday you need to call the police and report those threatening text. Save them and show the officers. You may also need to call the police station and ask why they havent been picked up on charges yet? The wife at very least should be in jail right now.

Yes TRO first and yes its through different court. After you get the TRO file everything in family court.

Did the police take a copy of the video? If not they should have and you should speak to a supervisor of the officer. If they are not pursuing this diligently I would also speak to a supervisor of officers.

DO NOT delete any more messages from them. Save them ALL.

One more thing, Did the officers give you any information on victims services? If not they should have. Look up victim services in your county and call them they should be able to help you with a lot of the criminal aspect of this.

The TRO should be filed in your county it is a seperate issue from the custody/visistation issue.
 
No, the officers didn't say anything about criminal charges, or victims assistance or really anything at all. The cart pusher and I wrote out statements (he saw my head get slammed into the truck) and my daughter gave the police officer a verbal statement of what she saw. They left, came back, watched the tape, took a copy of the tape and said they would be in touch. At some point they left the card, but I can't say when that was because I don't remember getting it at all.

Dad grew up in that town, I didn't. He may "know" people. I'm not sure.

The store manager took pictures of my bleeding lip, and I've since taken pics of it as well as the huge bruise she left on my leg when she kicked me.

The store manager said if I bought the tapes she would make me as many copies of the parking lot surveillance. I have one copy and will get 3 more tomorrow.

This NEVER should have happened. Dad should have stopped it, instead he staged the whole freakin thing. If the situation were reversed, I would most definitely NOT allowed my significant other to beat up on Dad. He wouldn't do it anyway, but that's beside the point. He wanted to find grandpa last night and "teach him how to treat a woman". I told him NO. We aren't going to dig our own graves like they are doing with theirs. We act appropriate and give them NO reason to take me to court.

I wish now that I would have denied visit yesterday. It would have definitely been in his best interest to stay home and receive his treatments and rash cream. As well as not be around other people who could hurt his already vulnerable immune system. He didn't need to be out in the cold and wind, either.
