Yesterday around 8 p.m, a few friends and I decided to drive up to Los Angeles, CA from San Diego, CA to a party that we had heard about. All my friends are 22 while I am 20 years old (turning 21 in 2 months). Anyways, like an idiot, I helped myself to a couple drinks. My friends were pretty buzzed and definitely in no condition to drive, so I decided to take the wheel (which I regret horribly). Just a little past Irvine, CA, I was somewhat tired so I decided to punch the speed up to 85 on the I-5 south. Just then, a CHP gunned me and about a mile later, I had a CHP on my tail and was pulled over.
I volunteered to do all his field sobriety tests. Then he offered me the breath test, which I also agreed upon. The first reading was .05, and the second reading was .07 . He then told me that since I passed the test and since I was cooperative, he would just give me a speeding ticket of 85mph.
Up until this point, he did not realize that I was underage. When he finally did, he told me that things just got a heck of a lot more complicated. At this point one of my friends also took the test and he was .05 and of legal age so the officer told me that he would not impound my car and instead release it to him. He proceeded to handcuff me but did not read my rights. He placed me in the back seat and we took off to the CHP station. I was seated next to the chemical breath test, which I volunteered to do as well. On both occasions my BAC was .05 . I was then fingerprinted and finally ticketed with VC 23152 (misd. DUI) and VC 23140 (Under 21 years old). I was not ticketed with 85 mph in the violation section of the ticket, but it is written down; "Speed Approx: 85" and "P.F/Max Spd: 65" My friends waited in the car outside the police station and then we finally went home.
My question is, having all this said... what chances do I have in court fighting this? This is a first time offence for me in anything driving related (never had a speeding ticket, not even a parking ticket). I also do not have a criminal record, but I fear I will now.
My second question is: I have been told that even with a suspended license, I can still drive to school(University) and to work if I apply for it. I was wondering if the DMV could also authorize me being able to drive to my parents' place, who live about 20 miles away from my college apartment.
