What is the name of your state (only U.S. law)? California
My company recently changed managment. I've been working at this company about six years, and have held the job tital of second in command in my department for about three years.The manager of my department just resigned and I was to fill his posession,Im without a question the most knowlagable guy in my department and have been there the longest but insted of promoting me they put a temp. In the posission and the reason he's a temp is because he is an elligal imegrant.Ive known this guy fore quite a while and thought he was my friend.I am a united States citizen and have been paying taxes sence I was sixteen and now I'm forced to take orders from someone who doesnt have the legal rite to even be in this country!This cant be ok or legal what can I do?

Did the company follow its own policies with regards to assignments and promotions? I doubt there is a policy that says they are required to promote the #2 guy if the #1 guy leaves.

Wen you say that you were to fill the retired manager's position, what do you mean? Did you have a guarantee in writing? Or, did you simply assume you were the heir apparent?

And how do you know that the person in the position now is an illegal immigrant? All because he is of foreign descent does not mean he is here unlawfully.

If you feel that the company has done something unlawful, consider speaking with an attorney. If you believe this person is in the country illegally, contact ICE and let them know.

While it might be frustrating to be overlooked, it could be that the powers-that-be feel that another person is better suited to lead the department at this time. That does not mean the decision was a good one, but it does not have to be good to be legal.

**A: there could be a problem if the company knows and hired the illegal. But that is a totally different issue and not yours.

The person filling the spot doesnt know a fraction of what I know.He knows laptops I know laptops,servers,hard drive arrays,network equiptment,pc's,computer lab construction and design,and quite a bit more.

And none of that matters a whit as to hiring.

Sorry, but they are free to appoint whomever they please to a position of authority in the company. You could check the company's promotion or employment policies and see if these appear to have been followed, but generally they are not required to go with the most technically qualified person. They may feel is a better manager, or that he is capable of performing some other task related to a management position better than you or other candidates. Or, he could just be the big boss's golf buddy.

If you have a grievance policy in your company, identify a written or oral contract that was broken, or a violation of written policy, and pursue it. If you feel some law was broken, report it to the authorities 9though that may doom your career there, too).

You might also consider seeking another job if you feel your time and experience is not properly appreciated.

And, maybe, he's a temporary pick while they fly for applications for the position full time.

So, investigate a little more before you leap to conclusions and leap into actions that you cannot take back.

Many people believe that a manager should know the most about the aspects of the job he/she is managing.

Knowledge does not make a good manager. Completely different skill set.
