Needshelp... Maybe I will buy you a Margarita in 9 days (8 now), when SIL gets out. Here in San Diego I know where they make the best. :)

I could use a short short-tempered lady in my life, I have a Landlord I want to give heck to! ;)

I did the google search too and all I put was SECTION 1983 and it came up IMMEDIATELY. Thank You, I could probably use that Margarita by then!!! I just moved into San Diego (over by Park Blvd and University) from the SouthBay (Chula Vista) and have no idea where the best anything on this side of town are ... :)

I just had trouble registering my younger kids in the school over here since it's the first time they're attending San Diego City Schools and they pissed me off so bad I ended up having 5 police officers taking us over there to make sure they registered the kids without my having to reach over the counter and beat that woman senseless!!! As far as your Landlord ... bring him/her on!!! ;)

Why does crossing state lines make the case even stronger??? If he was deprived of any of his rights why would it matter which state deprived him of them??? Or did BOTH states???

Didn't he tell you already? Don't let him fool you, T. He has to set his umberella laden adult beverage to the side in order to bang furiously away on his super-duper wireless fully-functioning, satellite capable, lap-top computer from the luxury of some over-crowded, bikini-cladded, sun and fun-filled beach somewhere, right now.

Today, one beach; tomorrow will be just another. ;)

I knew you had to be on a beach somewhere ... :D Just didn't realize that you had a super duper capable computer. We ALL know MS doesn't have one!!! Think maybe you could put that adult beverage to the side for just a while and pass through MS and teach them a thing or two ... :D

OK it sounds to me like you might know a thing or to about this whole beach thing, by any chance are you sitting on one too??? Out of curiosity what kind of computer do you have on your lap sitting there in your chair with your umbrella laden drink next to YOU??? :D

Questions for you ... Do you think there's a chance they still might try to extradite??? And what happens if they take my SIL to MS and THEN its proven it's a mistake??? Who pays his way back to Cali and do we still have a case??? Since San Diego was made aware of all the discrepencies and they didn't investigate aren't they just as guilty of depriving him of his rights??? Shouldn't they have looked into the whole thing considering they have no idea why he's still here after over 3 weeks??? Do you think MS will just wait for the time limit to expire so they don't have to admit to a mistake???

PLEASE, sit back in your beach chairs, take a few more sips off those umbrella laden adult beverages next to you, ponder the questions for just a bit and start pounding away on those laptops of yours ... :D

P.S. If you need help pondering ask the bikini clad beach bar girl to bring you a few more adult beverages, a little stronger this time ... :D

O.K., T. Short and sweet. Seems we're running out of room on this thread.

As of today, your favorite words in the English language are: "favorable determination". You will understand the significance at a later date.

If, at 11:59 P.M. of the final day, MS arranges extradition, then extradition will take place and such extradition will be legal. If and when the SIL gets booted (CA or MS), from the result of no prosecution, then a civil case can be made. How would he get back home from MS if extradited and subsequently released, you ask. The answer; the best way he can. There is no duty to arrange reverse transport back to CA. I have fingers crossed that the hold time will expire in CA first, and that no further hold on him can legally be enforced.

The Habeas itself, would take weeks to arrange a hearing on, and then weeks and possibly weeks more, waiting for a judicial determination once heard and plead. Cannot say.

You would have to start a new thread if this one gets bumped. O.K., T.?

Once again I would like to thank you for all your expertise and advice. I can't begin to tell you how glad I am I have come across such a knowledgable group of people. I appreciate everything. I would have been lost without you all.
I shall keep my ears open for those favorite words "favorable determination". I'm keeping my fingers crossed that the hold time expires also. They have posted another court date of January 20th. So far no word from ANYONE.
I shall remember what you said and if this thread gets bumped will definately start a new one to keep you all informed and to continue to get the great advice you have given me. I couldn't have made it this far without you guys. Thanx again.

P.S. Are you sure we don't know one another, my friends call me T ... ;)
 
TO EVERYONE,

My SIL was released this morning ... they said all charges were dropped!!! I want to know where do we go from here??? Do we still have grounds for a civil lawsuit??? How do we find out what REALLY happened??? Will we have to contact MS to make SURE this never happens again!!! :D
