If you accept a plea to a reduced sentence 9months - 2.5 years and you have a COUPLE of statutory mitigating circumstances and a few serious non-statutory mitigating circumstances , e.g. suffer from severe traumatic brain injuries,severe arthritis,elderly care etc Can a judge legally sentence probation or community control possibly base on a pre-sentance investigation I have a lot to loose after regaining my career that was held open for me after 1 MONTH COMA 3 months hospitalization & 5 months therapy for TBI and will never be intellectually able to achieve again. Should I consult with present qualified out of town counsel for further mitigation or just take the time,dump the career , family and expenses owed, Thank you
