I'm an 11 year employee of a company that provides paid disability benefits. The only time they pay benefits before pregancy is if you have other conditions that would put you or the life of your unborn child in jeopardy. Because of this I remained at work until my doctor took me out @ 34 weeks. I was put on complete bedrest due to severe sciacia(misspelled). I was also going in &out of labor & delivery due to asthama & braxter hicks contractions. The employer's disability group told me if I do not getting more medical test to prove my condition they would denial my disability. The cliams person even told me that he denials cancer patiients on kimo if doctor does not fully example why they can not work during there treatments. I felt as though he was letting me know his power. One week later when I got more documention from the doctors I was still denied. I spoke to the supervisor of the claims person regarding the cancer issue & my feeling threaten & I was not understanding what other types of unnecessary tests they would like a pregnant person to take on this temporary condition the discussion excalulated into an agrument & that evening I broke my water. And I went into labor 5 weeks early. My son was born with respiratory problems & went into the special care nursery for one week until he could breathe on his own. He is now healthy in size but one month ago he got pneunia & he respiratory just doesn't sound right. I have returned to work & I am not if I have a case against my employer.

I don't see how.

First of all, the comment from the claims person about the cancer shows that this is NOT pregnancy discrimination - they are not singling out maternity claims; no claims at all get paid without medical verification.

Secondly, your employer did not require you to stay on the job; you CHOSE to remain on the job unless your disability benefits were paid.

Third, there is no evidence in your post to indicate first, that it was your staying on the job that caused you to go into labor early; second, that it was your staying on the job that caused your son to contract pneumonia; and third, that he has any long-lasting problems connected to it that can be directly tied to the fact that you remained on the job.

You missunderstund, I was at home at 34 weeks of pregancy on complete bedrest due to the Severe sciaca nerve system with doctor notes & 3 months of the same history that said I would be endangering the life of myself or/& child if I remain at work. After spending 3 days in the hospital for contractions I was sent home with restrictions for complate bedrest. I certainly do not want to lose my job after 11 years, I applied for companied paid time off. And the company inside disability group determine that I was not disable enough to remain off work so I was declined pregancy disability leave. While I was on bedrest,keep in mine we are only talking about one week before my 35 week premature delivery, the group was having daily conversations with me & wanted the doctor to preform more tests. I believe they were harassing a disable person. And even though the baby was born 5 weeks premature as the doctor said in his notes would happen my appeal was denied. I like my job, but I do believe that premature birth was the reason my child has respiratory problems. I have 2 other healthy children & his chances would have been better if he remained the whole 40 weeks.
I understand your common but you should real look at things from other people's shoes. Are you a lawyer or just making commons?

YOu should get disability simply because you are a disabled speller.
Second, the company has every right to receive medical validation of your 'disability'. Your feelings have nothing to do with it.

Third, being pregnant is not a disability.

Fourt, in your first post you stated, for whatever reason, that you 'stayed at work'.

Unless you have thousands of dollars and the next 50 years, go for it. YOu'll lose.

HA! You're an idiot. You make fun of people for spelling badly and then you misspell FOURTH!!! (it's not "fourt"). ALso, how about doing some research you moron before wasting my time? Pregnancy is a disability as defined by FMLA and also by the state disability divisdion in my state, and probably in yours.

Stop wasting our time.
