President Refusing To Supply Information

What is the name of your state (only U.S. law)? Florida

The president of the association is refusing to give me the entrance gate key pad code to enter the property. I am a resident homeowner as well as a board member. He had given it to one board member who is also a resident owner. All other board members do not live on property. I have asked for it for safet reasons and he will not give it to me. I told him that I check with an attorney to verfiy and now he wants me to have my attorney friend send the association attorney a letter wasting the associations dollars. Is he not obligated to share that infomration to all homeowners that request it? Especially if the homeowner is also a board member. Can he descriminate and give it to who he choses and not ALL owners that request the information?

Were you not given this once before ? the gate is for cars I take it does every resident have it or just some ? If there is NO actual reason for you not to have it ? before you go to a atty try one last time, send to this person a certified letter, in the letter re state your request . If there is no valid reason for his non compliance then Id say its time to find a new person that will run for the board either for his seat , or you run for his seat.

I am completely uncertain about the problem, but, why not send the letter from the attorney friend? It seems this can be resolved quickly and easily. What possible reason could one have not to? Cost? Please.

Thanks for the advice**************But he has been the president since the beginning which is 6 years now. No one else wants the job and I my running is not an option.

We just installed the key pad so that we can keep the gate locked at all times. The entrance gate if for cars and they have given it out to the postman and delivery drivers like UPS & Fedex. The managment office has it. The President has it and one other board member has it. That is all I know of that have the code. There is NO actual reason other then he does not want to give it out to. everyone.

Is there somewhere I could research some language to use in my letter regarding the NO reason for his NON Compliance? We also have some other issues and need to know where to turn to read up about the condo laws for the state of florida.

So what is the skinny on the need for this code? If no one can get through the gate, where do they park? Why do you think they need to get through this gate?

Apparently, the other board member does not want you to have it also.

As long as you have access to your home the HOA is not REQUIRED to give you a code to access an automated gate.

And yet, they are not.

But, absent other facts, I agree with colourfastt, they don't have to provide equal access to all keys, codes or combinations to all members.
