What is the name of your state (only U.S. law)? TX

After researching the Rules of Civil Procedure, I've realized that this is can be a very complicated process. What relevant subjects in the rules do I need to ensure that I am very familiar with when I start filing the petition and starting the case etc...?

My biggest burden right now is figuring out how to get emails entered into evidence. Is it true that if I cannot, I can simply ask her to read the emails or relevant parts, or ask questions regarding my contact with her about our daughter and her lack of involvement through email?

What kind of geograhic restriction terms are you trying to modify?

You should review Texas Rules of Evidence to get some answers to your questions on the emails. If your ex's attorney objects to your email evidence and you cannot overcome the objection, then your evidence will not likely be allowed. In turn you will not likely be able to ask your ex to read any portion of that email if she denies the email or suggests it may have been altered. Such problems can be worked around by asking the right questions at the right time, but takes skill, strategy, and some luck to do it right.

For any pro se in a Texas family court dealing with contested custody matters, required reading should include at the very minimum:

O'Connors Rules of Civil Procedure - Civil Trials with forms on CD
O'Connors Texas Family Code

These are very well written and offer a lot of explanations. Attorneys often carry these with them to court hearings, and they are available in any law school bookstore in Texas or online at Jones-McClure publishing.

A pro se trying to litigate complicated matters such as modifications of geographic restrictions against an experienced family attorney in a Texas court has a very uphill battle to fight.
