Tinted Windows

Well I will say that I think that being pulled over for tinted windows is a BS for PC. I got pulled over for tented windows recently. I was told it was to dark. I then seen the same day several vehicles with the same tent as mine as far as look and darker. When pulling up the State law, I am perfectly legal and have the recpt. from the tenting company that did the tent to prove. I have been pulled over several times for something stupid, but not the obvious like, no proper functioning brake lights. I intentionaly did not fix them for that reason.

**A: hoe the hell could you drive if you had tented windows? Does your car have an auto-pilot feature?

In California they are giving out lots of citation and stopping people for tinting only. I don't think you will win.

Certain states if you read the tinting law, have an exception for out of state vehicles. In other words if its legal in your state, and you're going through another state, they wont ticket you just because it happens to be 5% darker htan their laws.

Again, that depends state by state. ie. if you're driving through 3 states, 2 may not give a ticket, the third may.

Easy thing to do is check the other state's laws before going there, takes a maximum of 10-15min of time if you dont know where to look. Under 5min if you do know.

If a cop thinks you have drugs in your house let's just let the cops break the door down at their own discretion.

Not true, not true, not true, and, oh, it's NOT true.

I suppose I COULD break down a door to look for drugs without a warrant or consent (or an exigency), but what the heck - I didn't need a career anyway.

And what's the Patriot Act got to do with it?

SEC. 213. AUTHORITY FOR DELAYING NOTICE OF THE EXECUTION OF A WARRANT

Section 3103a of title 18, United States Code, is amended--

(2) by adding at the end the following:
`
(b) DELAY- With respect to the issuance of any warrant or court order under this section, or any other rule of law, to search for and seize any property or material that constitutes evidence of a criminal offense in violation of the laws of the United States, any notice required, or that may be required, to be given may be delayed if--
`
(1) the court finds reasonable cause to believe that providing immediate notification of the execution of the warrant may have an adverse result (as defined in section 2705);
`
(2) the warrant prohibits the seizure of any tangible property, any wire or electronic communication (as defined in section 2510), or, except as expressly provided in chapter 121, any stored wire or electronic information, except where the court finds reasonable necessity for the seizure; and

This is just what it says. It allows a DELAY in the NOTIFICATION of the EXECUTION of the warrant. IT does NOT allow a search without a warrant (not counting the execptions to the warrant requirment). And, at least in my state, would only apply to FEDERAL officers, our state constitution provides a wee bit more protection than the federal constitution.

Geez, read the entire thing in the context of what is being said, not just what you want to believe.
