What is the name of your state? Texas

Do you need an attorney to represent you in court when your Probation Officer has already told you that he will back you up and recommend release to the judge or can both of you just go before the judge? What is the procedure? Where can I get a form or sample of the document to submit to the court to get a hearing scheduled? If this is deferred, will there be a conviction on record?

Have your probation officer show you the written report he will present to the judge. (Ask really nice.) If it sounds okay to you, go without the lawyer. The judge will pay more attention to the probation officer than your lawyer anyway.

Is This Probation-Deferred Adjudication the same as a Section 17. If so, I was told because I had a previous ARD (Section 17 with first DUI I wasnt eligible)? Also I had a bad lawyer at the time and did not complete the ARD?

Probation/Deferred Adjudication

Texas-----Deferred Adjudication meaning that if you do not get into any trouble with the law, pay your fees, report as instructed, etc, etc, during your time on probation, once completed, you will not have a conviction on file. There will be an arrest but not a conviction, as per the probation officer.
