What is the name of your state?Georgia
My boyfriend had to do 3 years of probation back in 1995. He finished 1 year and then didn't go dee the probation officer again. Since then, he has been pulled over and has had his information checked by the police as well as criminal background checks done by various jobs. Nothing has ever come up regarding the probation violation until now. He got pulled over and a warrant from Georgia has shown up from 1997.
My question is, why would it just now show up and does anyone know what the law says about this type of violation as far as sentencing?

Where, in CO or GA?

Carl gave you your answer here https://forum.freeadvice.com/showthread.php?t=203912 He continues to act suspitious getting pulled over by the police and can't hold a steady job, life on the lam is such a pain in the butt, but less than he will soon know.

Nothing has ever come up regarding the probation violation until now.
Because he fleed across the country to avoid the law, it is called being on the lam.... Did you know about this, you are aiding and abetting a fugetive, let's see interstate flight hopefully you will get charged with a federal rather than a state violation, federal prisons are much nicer than state ones for women, maybe you'll do time with Martha?

From which state CO, 1997 is about right for the violation in 1996.

My question is, why would it just now show up and does anyone know what the law says about this type of violation as far as sentencing? He will most likely have to at least serve the entire length of the original sentence plus anything else they throw at him as well as standing trial for what ever crime he comitted that caused him to flee in the first place and no they won't let you two share a cell, his cellmate will be named "Bubba"

when my probation got yanked i was ressentenced to do two months of county time. i dont know your boyfriends exact situation but i really doubt he'll do much in the way of "hard time" unless he has new charges.

easy answer

i'm from georgia too. this is an easy one.
#1. was this felony or misdemeanor probation?
#2. did he owe a fine or restitution that was never paid?
#3. how much of the 3 yrs passed before the date on the warrant?
#4. was he sentenced under first offender act?

if this was a felony case, he must have owed $ or it was a very serious crime he was on for. warrants for felony cases are usually only tolled if restitution is owed or it is a very serious offense. the date of arrest on the vop starts the sentence clock back ticking. if there was less than 2 yrs left at the time of the warrant issue - he will most likely sit in a county jail for a while. if he gets 12 months to serve - most likely would only serve 6. if $ is owed; the po wants to collect it. did he piss off the po back while he was still reporting? does he have past positive screens? has he been arrested for any other crimes since warrant was issued? did he leave the state or move?

there are many factors to look at. if he was sentenced as a first offender - he could be adjudicated guilty and resentenced to 3 or more years in prison for simply absconding supervision. this is very unlikely though if the $ gets paid and there are no new arrests. whatever you do - try to be humble. po's don't like to be attacked when they've done nothing wrong. remember who screwed up in the first place. the po is just doing his job. be humble and pay the $$$. don't waste $ on a lawyer if you don't have to. it's basically up to that po.
