From the state of Indiana

I have a travel trailer that was damaged being moved by a campground employee, with there equipment. This in the state of Florida. The campground is owned by a firm in the state of Mt. The manager in the campground tells me there is no damage. The police report and pictures show about thirty five hundred dollars damage to this trailer.

Now can I sue here in In. Are Fl. where the action ocurred. Are in Mt. that being there home office.

Now that I understand to that I have to file in the state that the inceident has occurred. Next: Do I name the manager of the campground along with the company it self. If they are not self insured how do I proceed with there insurance company. Do I have the right to have an ajuster come in and see the damage.

You can name whoever you want in the suit. Based on your brief first post, I would name the campground owner, the manager, and the employee.

If you file suit against them, they're going to contact their insurance company. You don't need to. If you want to just settle this via insurance, you'll need to contact their insurance company on the phone to open a claim. After it's open, do everything by mail CMRRR.

So far I have had no luke geting through to there insurance company.

I realy need a lawyer to file a suit and this needs to be done before the fifthteen of july.

Any help with this :confused: would be great.

How have you contacted them? Via certified mail? Phone calls do no good.

What's the amount of your damages? Is it really worth getting a lawyer involved, or can it go through small claims?

I will not know the dollar amount of damages untill this weekend. That being july 9, 10, . This is the first time I will have someone to go there and phisiclly see the trailer. If this trailer is not road worthy and is damaged beyond repiar the relacement value would be about 33,000 dollars for the trailer and 21000 dollars for the truck.

The person going in to see the units is planning on buying them if they can be saved. Before they can be moved he will have to pay a storage fee of about 1500 dollars.

So I am looking to recover this amount : $ 1500 storage fees
$ 8500 Trailer
$ 3500 Truck
Total $13500

I was planning on talking to the company after I know just what condition the units are in. Also my guess is that they are self insured .

This amount is to much for small cliams court. If I am going to far wrong here someone please let me know. Time is running out for me here.

I had forgotten to mention that I have had no contact with anyone from the company that I am dealing with. Only a e-mail that was post dated about three weeks before our last phone conversation. There have been six our more phone conversations with replies like I will have Mr. --- call you. Or Mr. --- is looking into this and will get back to you later this week.
There last and only thing in writing was the e-mail and this was a demand for the monies owed in storage fees.
They just act like they have the wright to do whatever the want.

Due to the amount of your damages, I strongly encourage you to contact an attorney local to the campground. There's only such much advice I can give you on an internet forum, and based on your posts I really think you need to contact a local attorney to handle this asap.

Final out come !!!

First off thanks to everyone for there replies.

The final out come wqas simple but not with out loss. I lost about Five thousand dollars !!!! I could not find a lawyer because of the dollar amount being so small.
So the manager of the camp ground recended his high price tag of storage.
I gave up on trying to sell, move, store these two items.
So I gave them to a church group took a tax right off and the bad guys now live in Colo. with no credit burdens.
