I filed for divorce almost two years ago. It's supposedly final, by words of the judge, but the papers haven't yet been filed. Long story, drunk attorney. I'm now representing myself.


The ex is still in our house. We have had it up for sale for about eight months. It was signed with a realtor a year past the date that the EXs attorney told me, in writing, that it would be. In the mean time, the ex has got the house looking like the Sanford's live there. I went over there a couple months ago and took tons of pictures, so I have proof of the diminished state of the house. There was an, at least ten foot tree growing through the swimming pool bottom. The garage could not be walked in for the dog poop and pee and clothes. I could see the kid's laundry laying in the pee mess. Unbelievable. I know you have got to think I am exagerating, but I am not exagerating an ounce. The landscaping is destroyed. There's a fence the ex ran through with his truck unfixed, and a storage shed in the back yard literally falling down. This is a neighborhood with 175,000 dollar houses in it. The rest of the neighborhood is immaculate. I told these things to that dead beat attorney, but nothing happened. He said he'd file contempt of court, but didn't. Now what is happening is that the house is not going to sell at the market value price we have it listed at, and we just lost a contract for the second time, because the ex wouldn't do the repair work necessary.

I guess the point is that the house won't sell at market value now, and I can't keep waiting for that money to come in. I've got myself and the kids cramped into an apt, wasting money that I don't have left and right.

I'm not sure that contempt of court is all that needs to be filed. I have notified my attorney and the court that I am now representing myself, so I need to file whatever asap on my own. Any input/advice?

I'm not looking for revenge. I just really need the money to come on in, and would love to go buy another house. I'm spending more on rent than I would on a house payment, and sinking fast.

I would as the court to ask her to get the f' out the house. She is clearly making this a situation as to where the property in not sell[able]. In regards to the paperwork, you may have a druken attorney, but the Judge if the paperwork was done should be in place. I am sure you had to be present during the final decree???

Anyway, move the court to get her out of the house.

Yep, had to be present during the final decree. I am the she. The he is the slob over there. The judge looked right at me, and said, "you are divorced right now, you don't even have to wait for the papers". Not sure what he thought I'd been waiting on, except to be single. But, the papers are still not through. At least the drunk attorney didn't sign the papers that the EXs attorney tried to pass off.

I still don't know what to file to get that house sold and my mula out of it. I guess Contempt of court and ask on that for what I want to make up for the lost cash.
 
I would move for a contemp, see who has the final orders to present to the Judge, if none, present some. I would ask the Judge to move him our so you can repair the house, in some states, and this is stretching it, the Judge can assign you complete title to the house if he is not making it avail to sell. If you present all of the evidence and information I think it should move the judge.

Hello-

I'm from MI.

What kind of recourse do i have if my ex-wife is using my last name still?
She is using my last name for professional work purposes since she is an international student and is working here while she is attending my medical school with her maiden name.

In the divorce agrrement, it was agreed that we go back to our original last names.

I just want her to abide to the court documents.

I'm concerned that she is using my last name for other purposes as well.

She has fasly accused me of domestic violence so my school has protected her rights. Well, what about the fasly accused? Do they have rights too?

My divorce lawyer at the time told me that her claims are without merit and that it was in pretrial brief (I think thats what he said) and not to be concerned about it since such allergations are made all the time in those briefs.

I find that my ex-notifited the school and made herself look like a victim and me, a jerk (for her gain) and at the school she teaches she uses my last name for my legal benefits since she is an interanationl student and applying for a locall job here.

I was concerend of not getting my school invovled since at this point what can they do..

You may be wondering why she changed her last name at the medical school and not at the community college. Well, at the medical school, my ex- knows that I'm there and she is very vindicative.

At the place that she works, she benefits because of my legal status. She is considered out of state/country when it comes to work and tuition. She is trying I believe to work and gain in state status.

what should I do..

I just want to be left alone..

she has caused me soo much grief and false accused me that I am still not over it all..

We were suppose to sell the house, pay off any debts, then split the leftover equity, which is pretty significant. What I was thinking was, since it's been almost two years, that I would ask that the house be sold in the most expeditious way possible with a lower selling limit equal to the house payoff plus the equity I would have gotten if the house were to sell at market value, plus the pay off of any debts. Then, I would still get what I was suppose to. Only he would be losing money. There is enough equity that that should work. I just wasn't sure that filing a contempt motion was the way to make that happen.

Almost get with it.

If you have the proof that this place is run down and trashed then no Judge will rule in favor of the slob.

Lady grab a gear and move forward. Stop being emotional and get factual. Stick to the facts and you will be the winner.

Very funny, emotional left a long time ago. You must have read what that other person accidentally posted on my thread. I just want to file the correct forms with the judge. Hehehe. I'm just starting to enjoy this. Maybe I'll become an attorney too.
