Property dispute

What is the name of your state? Wisconsin-We are currently involved in a lawsuit against our neighbor. He constructed a garage in 1996 that after we had a survey done it shows that it is 12 feet on our property. The previous owner had put in a septic system in 1986 that is about 10 feet on our property. This is a lake lot and the property we own is only 91 feet so we do not want to sell any of this. We want the structures removed. We have had 2 surveys done that are the same. Our neighbor now is having a third survey done. He had no survey done when he put up the garage. My question is could a judge make us sell him the property?

I hope you are suing for the removal of the encroaching structures. I have no idea why people do these projects without benefit of survey.

What has your attorney told you?

Good. It's not your fault he didn't bother to make sure he put his structures on his own property.

But look, he saved all that money by not paying for a survey!

Getting the the court to require that the septic be moved may be more problematic than getting the garage or shed moved.

We have already made an offer through our attorney that they could leave the septic system there until it failed or they sold the property, but they ignored the offer.

Looks like this property owner has a pattern of repeatedly placing improvements partially off their property.
