we are in the process of buying a condo on a golf course. in the mls listing and according to the selling agent, the insurance on this unit was included in the poa's. we are one week from closing, and now, the head of the condo assosiation told us that the insurance is NOT included in the monthly fees. i pulled my mls listing and it is clearly marked insurance included: yes and it is also mentioned in the poa are. ie poa includes pool service , ground maint., legal, water, insurance, etc. obviously, the selling agent misinformed us. in writing. what are my legal rights?

When the HOA is talking about insurance being included, they are referring on insurance on the building itself (all common areas). Any insurance on your your condo and it's contents should be insured under your own personal homeowner's insurance plan.

You were not mislead. You simply misunderstood.
