Hello,

If someone has had an immigrant petition approved, and is living in the u.s illegally waiting for their priority date to come up, when it does come up, if it is found out that they were here illegally can the approved petition be thrown out?

What visa are they applying for ?. Generally, if you are caught in the US illegally then you are deported. Exception to that are asylm seekers, people who land from Cuba etc..

Hello,

I believe that they applied for a family-based visa, their petition was approved, but if their priority date comes up and only then are they found to have been living here illegally, i wanted to know if the approved petition can be over turned? Even though their priority date is up.

Hi,

They entered on a nonimmigrant visa, a visitor visa, i think it's called a (B2). They've been staying here illegally waiting for their priority date to come up. If their date comes up, and it is found out they were living here illegally, can their approved petition be over turned? Even though their priority date is up.
