Question on stolen property

Hi, I am new to this forum. Sadly my daughter is a drug addict. She is awaiting a new court date in another town for driving after suspension, and failing to appear for court. She also has ANOTHER date in ANOTHER town to show why she has not completed her community service, for unpaid fines.

On Jan 4th 2005, she was arrested for receiving stolen property. I cannot find anything on New Hampshire laws, as to what the penalty for this could be. Keep in mind, I do not know yet what was received by her, or the value. She is 31, and I do not enable OR rescue her. BUT I am fearing jail time for her. Does her other dealings with the courts have an impact on how the judge will handle this?

ANY information would be greatly appreciated. Is it public information to find out what she received AS stolen goods?

AGain, Many, many thanks in advance. If anyone knows anything about the penalty for this, or anything about New Hampshire law, I would be grateful...

Well her attorney would be the best source of that information, but most likely she will do some jail time which may in some ways be the best thing for her since other attempts at diversion don't seem to work and sometimes jail is the only way to at least temporarily break the cycle of addiction. Keep strong, enabling and rescue don't work.

Thank you Met. I know that you are right. My daughter thinks I don't care because I do not rescue her. I am praying that however this goes it will be what is best for her long term.

If anyone knows of a site that I can check out the NH law on this, it would be greatly appreciated.

Absolutely. The courts are normally reluctant to impose incarceration on a person. However, if it is obvious to the court that stronger action is warranted to 'get her attention', they will deal more harshly than just a single incident. From your post, it sounds like she is more likely to see some type of incarceration than another 'slap on the wrist', which appears to be of little benefit.

The police report (redacted as needed) should be public record.

With her current legal 'history', there is really no way that anyone can guess how harsh the courts might deal with her. Needless to say, the 'soft and easy' approach appears to have not worked, so it is more likely that she will be dealt with more aggressively.

No offense, but if you do the crime,then be wiling to do the time.I feel for you as a parent & I feel for her being in recovery myself.The best thing you can do for her at this point is just what you're doing.At least in jail she will be able to go through a drug program & hopefully she'll be open to it.Make sure she discusses this with her lawyer (or public defender,which ever it may be).Usually here in California at least,if you're honest & admit that you have a problem with drug or alcohol,then the time is wavered on your other charges(as long as they're not voilent charges,burglaries,orabuse of any kind) & you are put in a drug treatment facility that is funded by the county until the program is over(6 months to a year)Maybe your state has something similar.Good Luck & God Bless you both.
