Question regarding collection

I recently (a few months ago) paid off (through settlement) a student loan through a 3rd party collection agency. About a month ago I noticed that the debt is still showing as past due on my credit report. I know it could take up to a year to be updated but called the original company that I had the debt with. They said they had to knowledge of a payment and that I still owe the full amount. I then tried to call the collection agency (their contact info was not easy to find) to seek confirmation through them (something they have been claiming to do for awhile now). I have contacted these people numerious times and every time they tell me that they will send confirmation (either by fax, email, whatever) but then they never do it. The actions of this collection agency are making me very paranoid as I thought this debt had been settled. Is there anything I can do from a legal standpoint to force the collection agency to send me the confirmation they have been promising me?

What collection agency was it? Do you have proof that you paid them? Is the tradeline listed on your credit report (the one not reporting correctly) listed by the orgiinal lender or the collection agency?

What I would do is send a DV to whoever was on my report and, at the same time, dispute the listing on my credit report as 'paid in full'. This way you either A) get the tradeline changed to paid or B) have a legal way to get them if they don't since they will be in violation of the FDCPA. BUT, if you ave no proof you paid, then you may not have any legal recourse no matter what.

Do not have them send confirmation of the paid debt to you, unless it is in repose to a DV. The credit reporting agencies will not accept this info from you, it must come from the data furnisher.

P.S. They DO NOT have the right to wait up to a full year to get the tradeline reporting correctly on your credit report.

The reason I was requesting proof of payment from the collection agency (Sentry, Inc.) was because the original creditor needed proof of payment before they would report it to the credit bureaus as paid. All I have is a cancelled check. I just do not understand why they are acting funny about sending me proof of payment if I have done everything they have asked of me and this has been paid in full according to them.

I decided to call them again about 5 mins ago, which was the first time in about a month. The odd thing was that they knew who I was without me telling them (could be because I have called to many times in the past). Of course, they tell me that they emailed it to me (which I never got) so asked them if they could just fax it to me instead. They claim that it should be faxed to me this afternoon so we shall see....but not going to hold my breath....:rolleyes:
