What is the name of your state? Maine

I had a question about getting sole and physical custody of my son. I wasnt married to his father. His father assulted me on Sept 21, 2004 and is currently in jail for that charge plus violating the PFA, tampering with a victim , and violating his bail agreement. The night he assulted me, he also threatened to kill our son. I was wondering if there was any chance that he could get custody or visitation. Please give me some advice because his friends are calling me and telling me there is a loop hole that he can use to get my son. Thank you.

probaly can get supervised visits

you can go for supervised visitations,giving his violent history.consult with a lawyer.and tell his friends to mind their own business,theyre not lawyers,and dont know what theyre talking about,this is between you and the father,and no concern of theirs.

First of all, why are you talking to his friends? :confused: Second of all, I hope you aren't even considering taking him back when he is released.

If you haven't filed in court and received a custody order, do so as soon as possible. The court will take his recent incarceration into account. There are statutes re; allowing a parent custody who has been convicted of Domestic Violence within a recent time frame. If you need help filing, contact your local Domestic Violence hotline for assistance. Include a restraining order in your filings- It will be free since you were a victim of the crime and you will be assisted at your courthouse with filling out the paperwork.

1. Are there custody orders right now? 2. Are there court orders at all?

You need to explain the above quote.

The only court order right now is I have a Protection from Abuse for my son and myself, which gives me temporary custody til 2006.

I was also just wondering if he is charge and convicted of Domestic abuse, will that help my custody case, where he threaten our sons life. Sorry I just want to keep my child safe and I dont want either of us near my ex because I fear for our safety. thanks for the advice
