Please don't think I am a lawsuit junkee...I have never filed one in my life! If you have read my other posts, you may think so. I'm just tired of getting screwed by people and want to find out if I have any legal options with my problems.
My husband and I traded in our 2003 Mustang at a Mitsubishi dealership on a 2003 Explorer because we needed more room for the baby. The Mustang was financed in my name through Triad Financial, and the Explorer was going in my father-in-law's name through Citi-Financial. Well, they were to pay off the Mustang at $14000. We left with the Explorer and the paperwork. Apparently, they had some crappy finance managers because they fired 3 of them since we got the car. One of the finance managers forgot to give us something to sign, so he went ahead and signed my name and my father-in-law's name. He was fired. 30 days later, they still hadn't paid for the Mustang. I check my credit and sure enough, it's affecting me. We go into the Mitsubishi dealership yesterday to find out what the heck is going on, and they have sold the Mustang without paying it off. And to top it off, they have the mileage listed about 10000 lower on Explorer paperwork! It sounds like a complete mess, but my lien holder told me to secure an attorney because they are bound by that paperwork that states they will pay it off. Meanwhile, it's affecting me. What do you think?
I was involved in an accident on June 1, 2004. A truck took the front of my car off. The guy admitted to being at fault (he was driving on the wrong side of the road trying to pass people in standing-still traffic). Anyway, I filed with my insurance company and got taken care of (well, as best as you can), but now the arbitration has gone bad and it's going to court. I received a letter asking what I would like the attorney to pursue.
1) Loss of use for 10 days - we had no car, and the rental didn't happen until day #11
2) My car was a complete loss, and was totaled. However, the loan was paid off and I received the change. Doesn't this still qualify for some type of loss? I mean, obviously, I had to start over with another car.
3) Deductible
Is there anything else I could add in? It really ticks me off that this guy admitted to being at fault, was cited by the police, and his insurance company doesn't think so.
Anyway, this issue is already being handled by an attorney, but I am supposed to advise him as to what I want. Is there something I should include here?
