I am 17 years old and will be 18 before the end of the year. I live my grandmother, and I have since I was born. However, my mother has legal custody of me. My grandmother has taken care of me since my birth and I have created a life consisting of friends, family, school, and a job living with my grandmother. Me and my mom have many problems. I feel both verbally and emotionally abused by her, and I fear that she may become physically abusive. I try to stay away from her as much as possible, and I'm finding myself not answering her calls and hiding from her when she comes around after a very verbally and emotionally abusive phone call from her a couple weeks ago. I was told that I could get a restaining order put against her, is this true? Is there any possibility that my grandmother could get legal custody of me? I really love my life and where I live, but I live being scared of my mother. I don't understand the laws for this situation and could use all the help I can get. Please reply to this or email me at xlilsweetheart4ux@yahoo.com if you have any information for me. Thank you.

I am not trying to be insensetive here but anything you do maybe pointless given the length of time remaining until you are 18. At least on the custody front your grandma probably wouldn't get a hearing and decision before you turn 18 and at that point it would be null and void b/c you would no longer be a minor (this is assuming that the original custody papers if there are any don't state otherwise- usually only an issue for 18 year olds still in high school)

As for the restraining order it could go either way when there hasn't been any physical abuse at least that has been our experience with the Courts that they would issue it sometimes under threat/fear of violence but always if there was physical contact.

Also you need to check into whether you can file for one you are a minor and someone may have to file on your behalf (you could ask your grandma)

Good Luck to you. I hate to say it but your best bet maybe to just lay low until you are 18 and then you can cut off contact if you so choose. But if she lays one finger on you CALL THE POLICE.
