Quick question- summer time

My court order states Zephyr "shall have physical custody of the minor child for the summer vacation from school, starting the first Sunday after the end of the school year and ending no later than the Sunday a week prior to the commencement of the new school year"

School is out tomorrow.

This would also be my regularly scheduled weekend.

Where does our son go this weekend?

If this is your weekend, you get him for your weekend starting Friday (guessing that is when your weekend starts) as this is still considered part of the school year UNTIL Sunday. Then Sunday is the first day of summer and you would get him starting then until your ex gets visitation on his normal schedule.

Thank you- that was what I thought, but thought it would be a good idea to get a second opinion before I brought it up- ex has told our son he won't be coming up for the weekend

Ex better send sonny boy or Ex would be in contempt if you were to exercise your visitation.
You know I used to think my ex was a jerk until coming on here. Now i realize he is actually sane and lately he has even been civil (since I passed the bar at least )

I am not sure that I agree with Ohiogal on this one. I think it depends on how your orders read.

If your orders specify that your every other weekend is during the school year, and clearly defines summer separately, then I think that your ex could be right on this one...or that it could at least be questionable enough that it might not be contempt.

I also think it might not be a hill worth dying on...The fact that your orders specific a Sunday start rather than a Friday start would lead me to guess that the intent could have been to give your ex a weekend with the child before your summer time started.

If your orders specify that your every other weekend is during the school year, and clearly defines summer separately, then I think that your ex could be right on this one...or that it could at least be questionable enough that it might not be contempt.

I also think it might not be a hill worth dying on...The fact that your orders specific a Sunday start rather than a Friday start would lead me to guess that the intent could have been to give your ex a weekend with the child before your summer time started.

Good point Ld, additional info- school usually ends on Tuesday- but there were 3 snow days...so that's how it ended up being a Friday- if that makes a difference.

Also, did speak with dad last night- nicely told him my interpretation of the order, he agreed for kiddo to come to me on Friday, hopefully this will work out amicably

Definitely agree there. I am still expecting mine to go back to being the jerk he was while I was in school and he was making a lot more money than me and decided to make my life heck.

Actually it would put this Friday and Saturday in the school year because it does define Sunday as being during the summer. If this is her weekend during the school year then it is her weekend. Summer doesn't start until Sunday.
