Hi.. My father has a quit claim deed on his house that lists myself, my sister and brother as having rights to survivorship. My father is also the co-signer on my brother's mortgage.
I am wondering: if my brother defaults on his mortgage and/or has his house foreclosed on, can the mortgage lender come after his share in my father's home, since he did co-sign? And, if so, what should we do to prevent this from happening, since my brother rarely pays his mortgage on time.
thanks.
