What I suspect is that this nicotine test is something they chose to use to get rid of someone quickly. And getting rid of a new employee who is not working out quickly is the best all around way to do it. What many people who smoke (even occasionally) do not sometimes realize is that some people have very sensitive noses, and can smell people who have been smoking like bloodhounds. (in many cases, these are former smokers who are very sensitized to their old drug of choice). Someone may have simply mentioned that they smelled cigarettes on or about this person. Or she may have, in casual conversation, have mentioned to a co worker or someone else that she does occasionally smoke. Either way, they for some reason, caught it out, it was true, she was tested, she admitted it, they elected to tell her she was terminated for violation of the no smoking (anywhere, anytime) rule. And the OP confessed and agreed to resign instead of being terminated.
If they'd wanted to, they could've called OP in and told her she was terminated for violation of the random walking on the wrong sidewalk ordinance or the style of her shoes or for wearing green socks. It would've been legal. She should still file for unemployment benefits while looking for other employment, the chances of receiving it may not be all that great, but it's always a good idea to file when one is put out of a job, regardless of what reason and let the unemployment system set up a claim and make a decision on it.
