Hi, I have a 2010 chevy truck that I purchased new in july of 2010. In July 2011 the truck would randomly shutdown while driving. I could not replicate this problem, and there was no check engine light, or other problems with the truck. It would shutdown in traffic, on interstates, secondary roads, parking lots, etc..

I took the truck to the dealership and they kept it for 20+ days randomly replacing componets trying to pinpoint the problem. It also wold randomly shutdown on them too. Eventually the called in a factory electrical specialist and he seemd to have fixed the problem. For about 7 months the truck ran fine, no shutdowns, just normal operation. Until last week.

My wife and I were driving home and the truck shuts off again. Same symptoms, not CEL's, no other problems. It is at the dealership right now and I told them to keep it for a few days to see if they could replicate the shutdown problem again.

Is this a justified case for the lemon law? I have given the manufacture a chance to fix it and the problem reoccured. Due the fact it randomly happens I feel it poses a major saftey concern. What are your opinions?:)

Oops sorry, I'm in west Virginia. I spoke with the service rep and told him to keep it for two more days to see if they can get it to shutdown on them.

West Virginia Lemon Law states the vehicle has to be out of service for 30 days, OR had 3 attempts to remedy the problem.

It also says that if the defect poses a serious risk of injury or death, It has to have at least 1 attemt the remedy the situation.

Is it OK to assume a vehicle randomly shutting down in traffic a serious risk of injury or death?

I like this truck But no longer trust it, If I pursue action what would be the best route to follow? Attorny Generals office? BBB? Or just contact a lemon lawer and let them do most of the work for me. I am not looking for a free truck, If I could get a newer model the same model, trim level, options, etc... and just transfer my balance to that truck I would be extremly happy.:D What are the odds a deal could be met with the information I have provided? I have no experiance in this type of situation.

You should speak with a lemon law attorney.

As for the "serious risk of injury or death" - that usually relates to something that would cause you to lose control of your vehicle - like the steering wheel popping off in your hands or the wheel randomly falling off. Your vehicle is fully controllable during the periods that it shuts down.

I don't consider the truck "controllable" when shutting down while pulling out into traffic, or merging onto the freeway etc... The accelerator is a control, and if I have none, a serious accident may occcur. This is a serious risk of injury or death in my eyes. Especially when it cannot be duplicated, and driven in a manner to prevent shutdown.;) Thanks for all the advice, I've contacted the manufacturer and there is a case/investigaton going, so well work from there, any more advise as in how to deal with them on this issue?
