I am from Washington state and was recently in a accident that involved me getting hit by a drunk driver. I have been getting calls from both of the insurance companies (mine and the drunk drivers) about the two people wh sustained injuries in the accident (both in my vehicle). It is clear that it was a no fault accident on my part but I am getting worried about the battle that seems to be going on between the insurance companies. The drunk drivers agent already tried to settle (1 week after the accident) and I refused the money they had to offer. My main questions right now are...

1. Both companies want me to sign a statement that would release all of our medical records to both companies. Is that something I should do?

2. Due to the injuries to my wife and niece my life has been very crazy the last week or so. I am curious as to how we should settle with the insurance company when the time comes. Should I get a lawyer or is it not that compex of a process?

Any information would be a big help at this time.

Get a lawyer ASAP!!!!

I am no legal expert, but I have had experiences with accidents and you DEFINATELY want a lawyer, or at least consult with one. Alot of auto-injury lawyers have no cost consultations. The other drivers insurance adjustor is out to SCREW YOU and your loved ones. Get a goo idea of what you are headed into first.

Please, do not sign anything without first checking with a lawyer. No matter who is asking you to sign it, even if it is your own insurance company, you must be very careful. Even if you think that your own insurance company has your best interests in mind, sometimes they don't.

If the drunk driver sustained no injuries he will be fine. To discourage him from driving drunk again and possibly killing someone, that power lies partially in your hands. Seek the advice of an attorney not because you want to get revenge, but to do what's best for all parties. A personal injury attorney can help pave the path for adequate compensation for the injuries sustained by individuals in your vehicle as well as the vehicle. The right attorney can make life financially uncomfortable for the person who chooses to drink and drive thus jeopardizing the life of others. Maybe next time he will think before the drink. Don't let an insurance representative provide you the legal assistance an accomplished attorney can do instead. Seek an attorney, it's the right thing to do.
