13 years ago I was charged with battery on an ex. He stalked me and harrassed me in my home. He came to my home one evening and was threatening me and calling me vulgar names. He pushed me and I slapped him in the face. He wanted revenge, so he went to the police department and pressed charges against me. I told them what happened , but he had a friend go with him and say he saw me slap him. I was arrested and charged. I was humiliated and it is on my permanent record. I have tried to get rid of it , but the state passed a law two months prior that if it was someone you had ever resided with it is domestic violence. I am not allowed to have it removed.
But adjudiation was withheld. What am I supposed to do to have this unfortunate event erased?

It sounds like that maybe this is NOT on your record. In some states, you can pay the highway patrol/state police to run your record. If you can do that, then try it.

Expungement/pardon

Standard answer: Expungement is generally granted for illegal arrests or unlawful convictions. Generally, pardons mean you are forgiven for the crime but it remains on your record.

Check with the governor or attorney general of your state to see how you can go about either of these procedures. Check with the Attorney General or the President for federal expungement or pardon.

Being female is not an excuse for domestic assault. You committed the crime you now suffer the consequences.

I do not believe she was ever convicted.

I cannot tell from her garbled post.

We're waiting for clarification.

I am not sure myself but I believe she was because she stated that the offense isn't one she can expunge. She wrote:

Edit: Maybe she will come back an enlighten us though and explain why she should not have to suffer the consequences of her own actions.

She already did suffer the consequences.

According to her post the offense cannot be removed so apparently THAT is a consequence, and one that she has to learn to live with.
