I live in the state of Florida and was ordered by the court to pay rehabilitative alimony to my ex-wife. In the final document it states that "rehabilitative alimony is inappropriate in order to bridge the gap to ease the transition from married to single status. However, it can be awarded when need and ability are shown and there is a plan to establish the receiving spouse's capacity for self support."

My ex-wife told the judge she wanted to go back to school to become a nurse. She has never taken any courses nor has she ever had the intent to do so. Can I go to court to have the alimony stopped? Can I sue her for all the alimony I've already paid out?

Thank you for your help.

Florida Alimony

Good luck. I'm also in Florida and it's really a "friendly" alimony state. I was told something like you were and then told I'd have to pay for 5 years anyway, even though the rehabilitative aspect is not really laid out. To challange it I think you need to show some sig. change in circumstances related to income depending on your decree. Good luck.
