What is the name of your state? What is the name of your state? GA/PA
Thank you to anyone who can assist me with advice. I will try to be concise and give only the details of my situation. Ga 1996 recieved a DUI, because of career choices I dragged it out for as long as possible not fully resolving the matter, after furthering my education and being consumed with work I recently acknowledged the monkey on my back and have decided to reinstate my license and found out this. On 12/97 on a family visit to Pittsburgh, PA I took the wheel of a vehicle and was cited, I was told to submit the ticket and the powers to be would take care of it, it was not and here is my predicament. 7 years later I find out that in order to get my license PA wants me to come back because of a missed court date (no prior knowledge due to constantly moving) pay a fine of over one thousand dollars and serve a sentence of 90 days for driving with a suspended license. Finally the question? How to serve justice without uprooting my life and spending three months in jail (my only time in jail was the few hours spent after my dui), reinstate my drivers license and throw away my bus pass. Thank you one and all for any advise. Best Regards, Tori

I suspect that the only way you can get this taken care of is to surrender.

HOWEVER, if you get a PA attorney and offer to trade a big fine for a jail sentence, they may go for that.

...Tori....contact a lawyer...I know, money....everybody wants money, but in this case, I would at least talk to a lawyer. It's amazing what can be done over the telephone re: the lawyer appearing in Pittsburgh instead of you? Try it...good luck. William

I don't know......

The mandatory penalty for driving with a DUI suspended license (at the time, it's since changed) is 90 days in jail. The poster was obvioulsy convicted in abstentia, and the appeal period has certainly expired.

I'm certainly not saying it's impossible, but I'm not sure if it could happen.

Please cite legal authority for convicting in absentia in Georgia.

I know in the States I have worked, moving around and not receiving your information from courts or DMV is gernerally not a good defense. But as they have said talk to a good attorney.

Ga/pa Situation

Tori, the situation would be much easier if your name change in Allegheny County PA did not hide the previous problems in GA. We have several clients looking to speak with you.

You DO realize that this thread is two years old and the chances are high that the original poster has long since moved on?

Yes. This individual has a habit of looking over his shoulders. Besides, his ability to move on is somewhat limited. He was busted in Atlanta for driving with IMPROPERLY WORKING HEADLIGHTS and NO PROOF OF INSURANCE,FALSE IN... The incident was Jun 06. Court date July 06.
