The issue is with someone on the Board of Directors of the condo. These people are simply owners of units in the building. One of the members is the one giving us so much difficulty. He acts as a "bully." Here are the issues we are having:
1) There is work being done on the building, and he said that all hurricane shutters will be permanently removed. I told him that they were installed in 2000 for the reason of protecting the apartment as well as its occupants. He said that they will be removed, unless I can provide him with the original permit. The issue is that when they were installed, a permit was taken out for the entire building. Therefore, there is no physical permit with the name of the apartment owner on it. Other residents are angry too, but he says if they cannot produce a permit, the shutters will be discarded. Ironically enough though, some of his board members have had their shutters removed, and then replaced once work was completed on their side of the building. I do not think he has a legal right to remove the shutters without replacing them unless he has permission from the owner of the apartment. Am I correct in thinking this?
2) When the condo was purchased, we purchased its assigned parking spot, which is an extra large spot, capable of holding two vehicles. A few years ago, the president told the maintenence man to split our assigned parking spot in half (since it was a large spot), so he can sell the other half to someone who wanted another spot. When this was discovered, we demanded the spot be restored to its original size, and it was. No one has been at the condo for a few weeks, and we come back to see that he painted lines in our spot, so that it has shrunk about 6-7 feet on one side. Do we have any legal recourse?
These are interesting situations. The shutter issue is a big one since the apartment is 8 floors up. Many shutter people (even in Florida) do not want to put shutters up on high buildings. The parking spot issue is not a huge deal, but it is based simply on principle. Why should something be taken away without permission or compensation? My family does not like being taken advantage of, and feel it is our right to stand up for what is right. Any advice would be greatly appreciated.
