My mother is going to hire the attorney again, for some other support issues (details in spousal support forum). What do you think would be the way the attorney or judge would handle my dad, as far as getting him to sign this form?? It's been over 20 years and there have been 3 tries to get him to sign. Would they make him sign right there in the court, when the date is set, or just send him "more letters"???....just curious. My mom's date with her attorney isn't until Feb. 13 (4 weeks away). Her attorney is also a judge and is sitting in a case until Feb 9, so we have to wait. In the meantime, I'd thought I'd get some perspective from this site.

Thanks HomeGuru.... That's definitely in the queue. As soon as we see the attorney, the ball will start rolling on various issues.

I know this is not the Wills Forum, but I thought I'd ask anyway? Can my mom start her Living Will arrangements before the QuitClaim form is signed?? She did a "will" 20 years ago (us kids were babies at the time, so what did we know) and I told her about all the pitfalls of not having a "living will", probate issues, etc.... My questoin is: Can she start a living will to complete her medical directive, state what assets she wants to leave who, her home, her IRAs, CD, Cash, other property??? etc.....She doesn't need the quitclaim form completed to get this started??? does she??

**A: yes, a draft can be completed.

**A: no, the deed has nothing to do with the will. See an estate/ trust attorney.
